Official Statement from Studio42 in regards to spam

It is strongly suggested that everyone read this statement. It will pertain to a large amount of the internet, especially to those who are obsessed with network abuse.
  1. Studio42 maintains a ZERO TOLERANCE policy on spam at ALL TIMES. I, the adminstrator, hate spam, and am tired of bouncing 50,000+ spams a day here. Of what little that gets through, it is annoying and time consuming to deal with. Face it, it is not wanted, so stop sending it.
  2. All email received becomes the property of Studio42 and can and will be posted to the web site without your permission required because your permission is not required. Since I have to pay to receive email, I own all data that hits my network. If you have a problem with this, then do not send any email this network.
  3. If I say it is spam, then it is spam. You don't have to agree with this, you just have to accept it. This is private property and only I, the system administrator and owner, make the rules. If you have a problem with this, then that is exactly the point: you are the one with the problem.
  4. Messages sent here that are in full compliance with the CAN-SPAM law of 2003 will be accurately considered to be spam. This determination is non-negotiable. The owners of this equipment do not like spam and no local, state, federal or international law will change that fact. This is private property, and as such, private rules over-ride laws. In simpler terms: My rules over-rule anyone else's rules, including those of the government and spammers.
  5. Studio42 does not allow the usage of any email address on this server for mailing lists. So, if you claim that this address was signed up for a mailing list, then you've lied to me.
  6. Unconfirmed opt-in is not acceptable. Since no address here can be used for a mailing list, any sign-up disclaimers are further negated. Even so, unconfirmed opt-in is still abuse. Unless one is using a closed-loop confirmed opt-in system, it is abuse. Regardless, Studio42 addresses are STILL not to be included on any mailing list for any reason. There are zero exceptions.
  7. Opt-out is a cop-out. Why should I validate my live address by opting-out of something I never signed up for in the first place? This just merely helps confirm that the message is spam.
  8. Quoting bills is meaningless. A bill is not a law. Get over it.
  9. Quoting laws is also meaningless. I don't care how compliant the spam is with any law passed. I don't care if there are no header forgeries, a valid email address is provided, a toll-free number is provided and a billing/contact mailing address is provided. Also, it does not matter if an opt-out link is provided as well. As I mentioned above, I am the administrator and owner of this network and server. In my realm, I am the supreme dictator for life and my word is the law of the LAN. As I said before: if I say it is spam, then it is.
  10. You may say it is not spam. If I say it is spam, then I win, my decision on any incoming traffic is final, accurate and not negotiable. Your claiming that your message(s) is not spam only serves to tell me that it is in fact spam.
  11. I do not have to accept traffic from anyone for any reason, it's part of the "I own it, my rules" thing.
  12. If you don't want your spamvertized site to be called a "scam site" or words to those effects here, then don't send your garbage here.
  13. If you are whining because your message has been posted here, that was because it was sent here and determined to be spam. You got busted, now go get a real job.
  14. If you are complaining because you are being called a scammer, or your site as a "scammer site", then you should not have sent your unsolicited messages to this network in the first place.
  15. HTML is for web pages, NOT for email. The internet is not the web, so get a clue.
  16. ISP's: We do interpret a lack of response as a lack of action. Complaints do require resolve and notification and proof of resolution.
  17. If I have blacklisted you, deal with it. That is your hint that you should go away. Please direct YOUR system administrator to the links provided in the blocking message and have them contact me via phone.
  18. The administration of Studio42 determines what traffic this server will or will not receive. You may not demand that I must accept your messages because I do not have to accept them.
  19. If you live or reside in the following regions, or are sending email through servers located in the following regions, please note that traffic from these areas is not acceptable:
      Africa, all inclusive. Traffic from this region of the planet is deemed not necessary.
    1. APNIC/Asia: Traffic from this area will be largely blocked. This includes known spam-friendly nations such as China, Korea(North and South), Thailand, Malaysia, Indonesia, Hong Kong, Singapore, Taiwan, India and Japan.
    2. France, Italy and Spain, Poland and most of Germany in Europe have proven to be ignorant on spam and have been determined to be spam friendly.
    3. Russia: There is no valid reason to contact this domain from a Russian IP address. Sorry, but your ISP's like to run a scummy network and I am tired of it.
    4. Netherlands: A region will known for abuse and over-tolerance, and as such I have no reason to accept traffic from there.
    5. Middle East. This includes Iraq, Iran, Sudan, Turkey, Saudi Arabia, Arab Emirates, Pakistan, Afganistan, Lybia and other Arab nations. I have no business in these areas and it makes no sense to therefore accept data from these regions.
    6. All LACNIC space, especially South America, namely Brazil and Argentina, with both being the largest nations in the contintent, and since administrations are ignorant in regards to spam.
    7. If you are blocked by the Studio42 Blackhole, then please do not request removal, it will simply not happen. I will block you at the router if necessary.
